Principle

This website is deliberately designed to collect as little data as possible: no cookies, no tracking, no third-party services — all resources are delivered from our own server. You can contact us by email, by phone or via the contact form, which sends your details exclusively to our own mailbox.

Visiting the website (server logs)

The website is hosted by Vercel Inc., USA ("Vercel"). When you visit it, the hosting provider processes technically necessary connection data (including IP address, date and time of access, requested address, amount of data transferred, referrer, browser and operating system details) in order to deliver the website and ensure IT security. The legal basis is our legitimate interest in secure and stable operation (Art. 6(1)(f) GDPR). We have concluded a data processing agreement with Vercel under Art. 28 GDPR.

As Vercel is a US provider, personal data may be transferred to the USA. Vercel is certified under the EU-US Data Privacy Framework (DPF); the transfer is therefore based on the European Commission's adequacy decision (Art. 45 GDPR). In addition, EU Standard Contractual Clauses (Art. 46(2)(c) GDPR) have been agreed in the data processing agreement. The server logs are stored by the hosting provider only briefly and deleted automatically — with the plan currently in use, within about one hour. We do not store them for longer or combine them with other data.

Contact by email or phone

If you contact us by email or phone, we process the details you provide (e.g. name, email address, phone number and the content of your message) exclusively to deal with your request. The legal basis is Art. 6(1)(b) GDPR (steps prior to entering into a contract, or performance of a contract) or our legitimate interest in answering your enquiry (Art. 6(1)(f) GDPR). Our mailbox is operated by IONOS SE, Montabaur (Germany); we have concluded a data processing agreement with IONOS under Art. 28 GDPR.

Contact form

If you use the contact form, we process the details entered there exclusively to deal with your request: the type of request you choose, name, email address, optionally a phone number, the content of your message and your wish to receive a reply in English, and – depending on your request – your search details (e.g. apartment of interest, number of rooms, move-in date, household size, budget, parking space) or, as a tenant, the property, the apartment and the type of your request. The data is transmitted in encrypted form via our own server function at the hosting provider named above directly to our mailbox; the form data is not stored on the server beyond that. The legal basis is Art. 6(1)(b) GDPR (steps prior to entering into a contract, or performance of a contract) or Art. 6(1)(f) GDPR (legitimate interest in answering your enquiry). Entries are checked automatically for spam — without cookies, without tracking and without any third-party service. The retention period is set out in the section below.

Search profile (only with your consent)

If you tick the box for a search profile when choosing "Looking for an apartment", we keep the details from the form (name, contact details and search details) beyond handling your current enquiry, so that we can contact you as soon as a suitable apartment becomes available. The legal basis is your consent (Art. 6(1)(a) GDPR). Consent is voluntary; without it, we only deal with your current enquiry.

The search profile is stored in our mailbox (IONOS SE, see above) and is not passed on to third parties. We delete it six months after you gave your consent, or without undue delay if you withdraw it. You can withdraw your consent at any time with effect for the future by sending an informal email to info@mietfokus.com (Art. 7(3) GDPR); this does not affect the lawfulness of processing carried out before the withdrawal.

Retention period

We delete enquiries and the related correspondence as soon as your request has been dealt with conclusively, but no later than twelve months after the last contact. Search profiles are subject to the shorter period of six months (see above). If your enquiry leads to a tenancy, or if the correspondence must be retained under commercial or tax law (§ 257 HGB, § 147 AO), we keep the relevant documents for the statutory period of up to ten years and restrict processing during that time to fulfilling the retention obligation.

Obligation to provide data

You are not obliged by law or contract to provide us with personal data; without the details required for your request, however, we cannot deal with your enquiry (Art. 13(2)(e) GDPR).

Your rights

You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20 GDPR), as well as the right to withdraw consent at any time (Art. 7(3) GDPR). To exercise these rights, please use the contact details above.

Right to object (Art. 21 GDPR): You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6(1)(f) GDPR (legitimate interest). If you object, we will no longer process the data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. Right to lodge a complaint

You have the right to lodge a complaint with any data protection supervisory authority (Art. 77 GDPR), in particular in the member state of your habitual residence, your place of work or the place of the alleged infringement. The supervisory authority responsible for us is the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg (LfDI).
